These are the terms for using OrbitalWork's websites and subscribing to our data feeds. They're written to be read. By starting a trial or a paid subscription, you agree to them. Questions: [email protected].
1. The service
OrbitalWork operates subscription data feeds built from public records. Our current live product, FreshLicense Feed, is a weekly email report and CSV of newly licensed Texas contractor businesses, derived from the Texas Department of Licensing and Regulation's (TDLR) public license files. Delivery is by email, normally every Monday morning.
2. Billing and cancellation
- FreshLicense Feed costs $99 per month (a discounted founding rate may apply where offered). Billing is monthly, in advance.
- It is month-to-month with no contract. You can cancel anytime; cancellation stops future charges and takes effect at the end of the paid period. You keep every issue you've already received.
- Free trials require no payment card and convert to paid only if you choose to subscribe.
- Where an issue-quality credit is advertised on the product page (for example, a credit for weekly issues below a stated row count), we apply it automatically.
3. Data accuracy — no warranty, as-is
Our feeds are derived from public records and provided "as is", without warranty of any kind, express or implied — including accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose. Public source files contain errors, lags, and revisions, and some values (such as issue dates) are derived rather than published. Every row carries a license number or similar identifier precisely so you can verify it against the official source before relying on it. Do that. Our feeds are analysis of public business-license records — business information, not consumer credit data. They are not "consumer reports," and OrbitalWork is not a "consumer reporting agency," under the federal Fair Credit Reporting Act (FCRA) or any comparable state law. You agree not to use the feeds, in whole or in part, as a factor in establishing any individual's eligibility for credit, insurance underwriting, employment, housing, or any other FCRA-regulated purpose.
4. Acceptable use
- Your subscription covers use within your own agency or company.
- You may not resell, redistribute, republish, or syndicate the feed or substantial portions of it, whether raw or repackaged, to anyone outside your organization.
- You are solely responsible for how you contact anyone in the data. The feed is a list of businesses, not permission to contact them. Before calling, texting, emailing, or mailing, you must comply with all applicable laws — including CAN-SPAM, the Telephone Consumer Protection Act (TCPA), and federal and state Do-Not-Call (DNC) rules — and scrub against the DNC registries yourself. OrbitalWork does not obtain consent on your behalf and makes no representation that any contact is permitted.
5. No guaranteed results; limitation of liability
OrbitalWork sells access to a data feed — not customers, appointments, or results. We do not guarantee that the feed will generate any leads, quotes, sales, or business outcomes, and nothing on our sites is a promise of results.
To the maximum extent permitted by law, OrbitalWork is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost business, arising from use of the service or the data. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose.
6. Changes to the service or these terms
We may improve or adjust the feed's format and contents over time. If we materially change these terms, we'll update this page and the "last updated" date; continued subscription after a change means you accept it.
7. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
